Cleary Giacobbe Alfieri Jacobs Prevails in Obtaining A Restraining Order Against the Borough of Haledon in Ongoing Cannabis Dispensary Litigation

On July 1, 2026, the Honorable Rudolph A. Filko, A.J.S.C., in the Superior Court of New Jersey, Law Division, Passaic County, issued a restraining order against the Borough of Haledon in the ongoing litigation involving This Budz 4 U LLC, which seeks to operate a cannabis retailer in the Borough. The order restrains the Borough from amending the current ordinance limiting the number of cannabis retail licenses or issuing Resolutions of Local Support to any other cannabis establishment pending the resolution of the litigation.

The Borough Council had previously issued a Resolution of Local Support to This Budz 4 U LLC and then rescinded its support after the Planning Board denied a site plan application. The Court reversed the Board’s denial, finding that its decision was arbitrary, unreasonable, and capricious. Despite the Court’s reversal, the Borough Council unanimously voted to deny the reinstatement of the Resolution of Local Support without any supporting basis. The current action challenges the Borough’s efforts to deny municipal support, along with its apparent coordination with a competing cannabis retailer to prevent the project.
